REsidence card for non Eu

Hi everyone! I need some advice and help on regards my husbands RC application ! He come here in march on family permit! He is non EU and I am EU! I been in UK before for 4 years and then left to work for Thomas Cook abroad still paid tax and NIN into UK bank account! I come back in January got job renter house and applied for my husbands Family permit which we got it ! Now I am applying for his RC but I don't have one ! I am worried that it will get refused as I don't have anyone! Anyone been in this situation !!!??
