EEA PR Continuous residence

Hello all,

I'll be applying soon for a PR after having lived and worked in the UK for 5 years.
My only concern is the bit with the continuous residence. While being employed (same employer for 5 years), I was posted overseas to Germany (still being on the UK payroll) for 5.5 months. In the same year I went on holidays abroad for approx 1 month, which took my time spent out of the UK to over 6 months in that specific year.

I have a document from HR confirming that my posting abroad (the 5.5 months obviously and not the 1 month of holidays) was necessary and key part of my role in the company.

I'm at a loss now because I don't know whom to contact. Do you know if this case (5.5 months posting abroad + 1 month personal trips) would be considered a breach of the continuous residence? Is there a way I could contact the Home Office to ask about this situation?

Hello,

There is a rule to have at least 180 in the country within an year, but there are exceptions.
You could attach a cover letter along with your empolyer explanations and proof that it was your job that required you to be out of UK. You should be fine, but it all depends when you qualify to apply, bacouse please keep n mind what it says on the Goverment site:

"Your residence card won’t be valid after the UK leaves the EU.

A new scheme will be available for EU citizens and their family members to apply to stay in the UK after it leaves the EU.

Sign up for email updates to find out when you’ll be able to apply to stay in the UK under the new scheme and what steps you’ll need to take."

I am not trying to persuade you not to apply, right the opposite, I urge everyone to do so if eligible.
