EEA Family Member Permit Surinder Singh

Hello! I am looking for some information, or people with more knowledge of this... Did have a look on the forum but so many people have different situations!

OK, I am a British citizen and have been living in Spain for the last 3 years. My girlfriend (due to get married soon!) and I have been living together for the last 2 and a half years and have all documents relating to this like contracts of our flat. She is mexican, lives legally here in Spain with me as we have a 'pareja de hecho' which is a partnership that gives her rights just like me and has a 5 year visa as a result of this.

Having found some information about the EEA route and came across the Surinder Singh route, so I'm just wondering if anyone has any more information and experience, maybe from Spain? It seems like we have to apply here, so we can gain entry and then apply for the biometric card and visa to stay in the UK.

Also, when I was first looking at this, I was worried about the earnings per year, but it doesn't seem like it applies to this?

At present, Unmarried Partners don't qualify to reside in the UK under Surinder Singh. The CJEU is yet to rule on this (Case ref: UK v Banger C-89/17).

Ok yeah thank you. We are due to marry soon though.
