Hi,

Is it possible to get married to an EU national while on reporting duties with IS96 if non-eu still has his passport with him? The non-eu has a flr(fp) pending with the home office and about to do a JR for this refused ILR. Is there a chance of being detained? They are both not living together but will do after they get married and have photos/messages as proof of relationship.

EEA EFM does count if he had a residence permit. As he was refused on the EEA route, he is an overstayer from when his last visa expired. JR won't changed that.

Is this a 'genuine' marriage or one only to provide a route for him to stay in the UK? How long have they been in a 'relationship'?

Are you aware he is required to give 28 days notice (with his 'partner') to an HO approved Registry office. They will then notify HO of their intent to marry and this notice period could be extended to 70 days for HO to investigate and/or interview each of them separately before HO will allow them to get married.

Yes there is a risk that he is detained.
