Hello everyone, we applied for a derivative residence card (zambrano) based on our british child. My self husband and two kids. We submitted all documents including 4 passports and one british passports, on the 3rd sept.17..Fees taken on the 4th sept. Employers carried ecs check in Sept. They gave us 6 months to work. We heard nothing from them until today. They have rejected our application claiming we did not include our passports with the application which is not true. Everything was sent to them including our BRP. Pls help what do we do now.

Write and explain to them that the passport was indeed sent to them and that the refusal is clearly unlawful and they should check their system.

Especially check their passport bank (35).

Interesting case Vinny. With the Home Office , they always strive to put migrant in a back footing position. They are so dishonest.

Hmmmm, (back footing indeed). What do you mean by " Everything was sent to them including our BRP" (Biometric Resident Permit) Were you having leave to remain before or what? or you mean biometric form.

Get a legal person or if you think you can draft a letter yourself then try to write to them and once you can't get any head way just get another passport from you embassy with police report and re apply. Also i hope you understand fully the route you're taken though?

Good luck.
