When to submit the EEA PR Application ?

Hi all,

I was wondering if someone can point me in the right direction. Is there any official guidance or rule on when a Non-EEA national should (or can) apply for a PR ? I will explain a few details below, hopefully that will clarify my question.
  • I am a Non-EEA national married to an EEA National since 20 June 2013.
  • I received my Residence Card (RC) on 19 February 2014 and its due to expire on 19th February 2019.
  • My wife (EEA National) has just applied (Jan 2018) for a PR application but hasn't received a decision yet (she has been exercising treaty right in the UK since Oct 2012)
  • We will be married for 5 years on 20th June 2018
  • I have been a resident in the UK for 8 years (Since Jan 2010 on a Student VISA then Post Study Work Visa. Before applying for the EEA Family Permit)
Lastly, I was waiting for my RC to expire on Feb 2019 and then submit a PR application, however, if I am eligible to apply for a PR before my RC expires I would prefer to do so. (My wife and I have a mortgage in London and a baby on the way & with the uncertainty of BREXIT I am planning ahead)

Any suggestions will be much appreciated.

You can apply 5 years after the date of marriage.

Thank you very much for your reply.

It's good to know that I can apply on 21 June 2018 (day after the 5th anniversary) and don't have to wait till Feb 2019 to apply for PR.
