ILR through spouse or independently?

Hello,

I was hoping someone could help me.

I am a Canadian in the U.K. under an EEA Family Permit through my husband who is an Irish national, for the past 5 years. My husband has not formally confirmed his permanent residence status despite being employed here since 2006.

As my visa is about to expire I am about to apply for Indefinite Leave to Remain.

My question is:

- is there a difference between me applying independently, or could my husband apply for permanent residence, adding me as a spouse?

- If he applies, and adds me to his application, will I still have the same possibility of applying for citizenship in 1 year?

The reason I ask is also because I understand EU nationals can use the passport check-in service (assuming co-applicants can as well) and I require my passport for a family visit within the next two months.

If you are on the EEA route, you apply for PR under the EU regs (costs £65) and NOT for ILR under the UK immigration rules (costs £2,287).

Irish citizens are automatically considered settled in the UK.
