EAA Family Permit Refused

Hi Guys,

I am new to this forum but been reading quite a lot to help me apply for EAA Family Permit for my wife.

She got refusal today on the ground that she didn't provide the following:
  • Evidence that I hold a French Passport
  • Evidence that I am a qualified person in accordance with EEA regulation


I was with her in Sri Lanka when we applied and we did provide photocopy of my passport, 10 Months payslips, letter from my employer and my contract.

I am a bit surprised by the outcome and I like to know anyone had experienced this before.

We did send both of our documents via VFS Global in Colombo, impossible to contact them by email/phone to ask what went wrong. I did raise an enquiry to Home Office regarding the situation.

I have read in couple instance in here that we need sent the sponsor documentation directly to Sheffield, is this still case?

Very confused:( Can you please help me figure out this one.

It seems that they didn't like uncertified photocopies of documents despite what's stated on the website.

Are you working in the UK?

Yes, I am a resident and working in London for the last 13 years.

Yes I am working in London for the last 13 years.

The home replied to my email saying that they can’t help me on this instance and to refer to their refusal letter and to seek legal advice.

I was also wondering about certification of my documents. Can you certify Passport, payslip and contract of employment?

This was what their website stated:
All documents submitted by customers applying for Tier 1,2,4,5 & Family members of European Economic Area (EEA) and Swiss nationals visas will be scanned at the visa application centre and sent electronically to UK Visas and Immigration.

The new process allows you to keep your supporting documents during the application process. Wherever possible, your documents will be returned to you once they have been scanned at the visa application centre.

You can also submit photocopies you have made yourself, but they must be clear and legible.
Check with them as to what are still true. The third paragraph is clearly false, if they refused as a result of ignoring your photocopies.

Yes I am actually to trying to get in touch with VFS but no luck so far as they don’t have to email/phone on their website.

I am trying to get legal advice here in London.

Just one question, I was wondering if I have to sent the “sponsor” (mine) separately to Sheffield as some post suggest, it will be easier as I can sent original of the documents, do you know if this could be done?
