ROR or Wait till March 2019 for PR

Hi Everyone

I am a Non EEA and married to a EEA national since July 2014, Got my RC which is valid until Feb 2020.
Things has been really up and down since we got married. In 2015 first year of marriage she was addicted to drugs, alcohol and Infidelity. we had arguments many times, I wanted when she give up these habits, one day due to some argument she attacked me with knife, I got injured and was taken to hospital, police as called in and they detained her and gave her 30 days domestic violence restraint order. After 30 days she begged me for forgiveness and i forgave her, we started living together again, For next 2 years she was alright, she was working all the time. Our relationship was alright, we went on holidays abroad 2 , 3 times together. Things were working nicely and we were settling down in life.

Unfortunately from last 3 to 4 months she got in touch with her ex boyfriend and she started the same drug, alcohol and Infidelity. She has been staying at his place for weeks on and off, I am so devastated, I cannot take it anymore, my health is deteriorating due to stress. I really love her and do want when she go back to that crap life again.

One of my friend has advised me to do a divorce, we are living together since April 2014, She has been working pretty much during all this period. We have joint bank account, address, GP everything.

Please anyone guide me on this what shall i do? Can i apply for ROR? if yes then how long will be the process of divorce till ROR.

Is the lady working in the UK and is she happy to proceed with the divorce.

Hi Obie, Thanks for reply.

Yes she is living in UK, infact we are still living together, she is working as well.
I think she will be ok if i decide to leave her and file for divorce. Tbh i have not discussed with her yet, just want to explore my options first. I am the one who is suffering here, she is enjoying her life to fullest.

On the face you appear to meet the requirements. You may apply after divorce, provided you are in work or have sufficient resources.

Yes i am working full time. only thing scares me is that if HO will linger on my case and until Brexit deadline approaches. I am living legally in UK since sept 2010.

Can i apply for PR directly? or ROR first?
