Non EEA family rights after 5 years

Hi Everyone

I need some advice please. My son is 15 , he is Currently in the U.K. on a family permit as his father is married to an EU national. They have now separated & I don’t have citizenship so would like to know if I can apply for leave to remain for my son . He had been here for 5 years.

Their (father and son) rights continue until the divorce decree absolute is granted.

If they have been here for 5 years and the EU sponsor was a qualified person exercising treaty rights, they should be able to apply for PR.

What is your immigration status?
