Nephew for EEA National

Hi,
I have an nephew is 12 years old. If his parents send him to UK for school, but staying with me. May I apply him to be an EFM of EU national? According to one of the uk act I read, minor in UK requires a guardian and I can be registered as my nephew guarding while he is in UK. Would this be sufficient for applying as EFM?
