Hi everyone. Not sure if this question is already answered but couldn't find anything. I'm a British citizen living in Prague with my fiancee. We've been living together for more than 2 years. We are coming back to the UK and thought about surinder singh visa (my fiancee is from Russia). The question is: do we have to be married for applying surinder singh or can we apply while we are engaged?

Many thanks in advance,
E

There is a case pending at the ECJ as to whether unmarried couples are eligible for Surinder Singh. But it is the UK government's position that the SS route applies only to married couples.

How long have the two of you lived in Prague? What proof of having moved the "Centre of your life" there do you have for you (the British citizen)?

Thanks for the response. She's been living in Prague for 5 years and I've been living for 3 years. The reason I moved to Prague was my job so I worked in Prague all the time. We just wanted to get married on a different date but I have to move back to the UK in late Sep because of my job so we were thinking about sorting the marriage then apply for the visa if that's the only way.... Last question; we can get married say in August and then apply for surinder singh route straight away, right?

Many thanks again
