PR for an EU citizen - can ex spouse be added to the application

Hi all,

I'm an EU citizen who's lived in UK for just over 5 years. I'm about to start my PR application online as I intend to apply for UK citizenship.

I was married to a non-EU partner for 8 years but we got a divorce (amicably for the most part) earlier this year. As far as I know he hasn't yet contacted the home office to inform them of the divorce.

He now wants to apply for a PR and needs lots of documents from me, including my passport. In theory, he fits all the requirements for a PR. However, I want to sort out my PR first as I'd rather have that security before Brexit (and I want to apply for a passport next year) and so I'm not willing to give everything to him first. His 5 year residence expires early next year. Also, I'm worried that he hasn't let the home office know about his current situation.

If I do decide to help, is it possible to add an application of an ex partner to my online application?

What are your thoughts and advice on this?

Hi Deja123

I'm not knowledgeable on EEA-non-EEA divorces and EEA (PR) - but I think Retained Rights of Residence may apply to your ex, unless you were married for the entire 5-year qualifying period, which it sounds like you may not have been.

Have you done a search for 'Retained Rights' and 'divorce' on this forum, online and on HO website?

Hopefully one of the more knowledgeable members/moderators can advise you more.
