Urgent: VAF5 Form Dependent Spouse?

Hi guys,

I have a quick question that I hope someone can help me with please?

This is the situation: I am an EEA national and I got married to a non-EEA spouse. As far as I know we have to fill out the VAF5 form in order for my spouse to join me here in the UK, which is this one: https://assets.publishing.service.gov.u ... 0/vaf5.pdf

On page 3, part 5 for the Finance and Employment section it says:

"TO BE COMPLETED BY
- extended family members of an EEA national applying on the basis that they are dependent on that EEA national, or
- dependent direct family members (this does not include spouses, civil partners or children under the age of 21)"

My spouse works and has their own income and is not dependent on me. They will pay for their own flight ticket when the paperwork is sorted to join me in the UK.

My question is: considering that my spouse is not dependent on me, does my spouse need to fill this section in?

If not, where is my spouse supposed to tell about their employment and financial situation?

Thank you!

It does not mean dependent on you financially. A spouse is your dependent for eea FP purposes, ie dependent on your EU nationality and exercising treaty rights in the UK.

That makes sense, thanks a lot CR001.

Another question I have is, does it harm the application if my non-EEA spouse is not financialy dependent on me and they have their own salary and income?

No.
