EEA family member and sponsor working abroad for 1 year

Hello. I'm in London with EEA family member visa. Next year I'm going to apply for my residency ILR but my partner has got year contract in Lithuania and won't be paying TAX here. Will I have problems because of that applying for my residency?

You only have the right to reside in the UK if your partner is exercising their Treaty rights here.
