Applying for spouse visa

Hi,
I am going to apply spouse visa coz my wife is eea memeber but living in uk. I was in uk on student visa 2011 after completing my study i wanted to apply post study visa but that time home office cancelled that rule and i was worried coz my student visa will expire soon so i decide to apply flr(fp) coz one of my friend told me don't be overstayed that will be very bad for your travel history. So after been waiting long almost one year no answer from homeoffice i decided to come back to my home country so I book a ticket and came back here to Pakistan with out informing home office that i am going back. Few months later they sent me a latter regarding my case flr(fp) coz my friend was living that address and he sent me a picture coz home office thinking i am still in uk.
So i just wanted to know do i need to contact home office before applying that spouse visa?
ANY HELP WILL BE APPRECIATED...

What EU citizenship does your spouse hold??

It is not a 'spouse visa' if your spouse is EU (not British) citizen. It is an EEA Family Permit.
