Retained right residence after Brexit ( Home Office reply )

For those applying for retained right of residence after march 2019
Dear Home Office,
Under regulations 10(5) of the 2016 EEA regulations
When a NON EU NATIONAL apply for RETAINED RIGHT OF RESIDENCE after divorce
applicants need to demonstrate that at the date of application their EEA national family member are ‘exercising treaty rights in the UK’ either as a worker, self employed or self sufficient person.
What will happen after Brexit ( 29th March 2019 ) ? according to settled or non settled application main requirement for eligibility under the settlement scheme will be continuous residence . They will not be required to have comprehensive sickness insurance or exercising treaty right in the UK
So can Home office please confirm what documents a NON EU national need to send when they apply for RETAINED RIGHT OF RESIDENCE . Will they still need to send documents thats EEA national sponser is exercising treaty right until divorce finalised ?
