PR for non EU family member, sponsor has PR

Dear members, please could you help with one question

An EU citizen ( sponsor) has got a PR already and now the spouse is applying for PR.

Going though the form , I’m confused- it seems we need to list all of sponsor’s activity, full employment history etc again? Can’t we just enclose his PR document?

Are you using the paper form?

What was the date when the sponsor was deemed to have acquired PR, as indicated in the letter received with the blue DCPR card?

What are the 5 qualifying years you are applying for?

Yes the paper form , can you use the online one for non eu family member ? The sponsor was granted PR December 2017, the non EU spouse is applying based on completing 5 years residence in the Uk cohabiting with EU sponsor ( arrived in the UK December 2013)

No - family members applying by themselves use the paper form.

The DCPR card will prove that the EEA qualified person was exercising treaty rights in Dec 2012-Dec 2017, so you'll only need to provide information and evidence relative to the qualified person's employment and residence in Dec 2017-Dec 2018. I would explain in a covering letter that you're not providing again the evidence/information relative to Dec 2013-Dec 2017 as that period is covered by the DCPR.

Thanks for your reply. Are you sure I need to prove sponsors employment for the last year too( since he was issued with PR)? I thought I only need sponsors PR and my own paperwork covering 5 years qualifiyng period. Thansk

Yes, positive - you need to provide evidence that the EEA citizen was a qualified person throughout *your* 5-year QP, which is Dec 2013-Dec 2018. The DCPR card proves the sponsor was a qualified person during Dec 2012-Dec 2017, so the period Dec 2017-Dec 2018 is missing.

what happens if the sponsor stops working after securing their PR, would it stop a family member from qualifying for their PR? from what i know you only loose the PR status if you are absent from the UK for 2 years, there is no requirement to be working from that immigration perspective?

no it was theoretical question. lets say the sponsor stops working in January 2018 ( got PR in Dec 17). what happens to family member in that case. im asking as i was under strong impression once your sponsor secures a PR all you as a family member need to proof is your legal residence in the UK
