EU settlement scheme/SS requirements

Hello I’d like to know if anyone knows the requiremts for Surinder Singh applications being made to the new EU settlement scheme? Must the British citizen be exercising treaty rights for the non EU spouse to make an application or is it based on continuous residence?

They will look at whether the British citizen has exercised their treaty rights in another EU country before returning to uk. Whether the BC citizen lived and for how.long with the non EEA family member and so on.
They will not look at whether BC exercised their treaty rights in UK three months after returning .
Eu settlement scheme is residency based not on whether the BC has exercised treaty rights after returning
I read the above in one of the "statements".
