Seeking help about Divorce and ROR please...

Dear all ,

I hope that you are well. I hope that someone can give a. Advice on my case.
I will try to make short and clear .

Me and my wife are planning to start divorce unfortunately didn't work out at we expected ...
The good thing that is it did finish very badly and she wants me to sort out my visa case before closing the chapter forever.


So ,

- Married on July 2013 back home
- EEA FP issued November 2013
- EEA 2 issued May 2014
- Stoped living at the same address November 2015 until now

And :

- We not divorced yet and we didn't start nothing / we are on daily contact
- She is working on a full time position
- She is having some council benifts for house ( I have no clue what's that)
- I work full time , I have no criminal records or whatever so
- she stoped working few times when changed job and city( 1 month max )
- we have no kids



* I know now with Brexit things are complicated , I'm a bit worried about this to be honest , I didn't even visit my family since 2 years just cause I wasn't sure I say at airport we not living together they could give me hard time.


Do you believe that my case is straightforward and I have a good chance for this ROR ??


Does anyone had a similar case so he can give an advice ?

And if you could suggest please any good lawyer around London city will be great , I don't want to mess up anything cause this will decide my future in this country .....

Is she prepared to assist you. If she is on benefit as you claimed, is her work effective and genuine?

Yes she genuinely works with lending company and she got her contract and all.
Is it a little help from the council for housing I believe , and she is willing to help also

Hello to everyone,

I’m seeking some advice here.

- married EU national in 07/2013
- EEA FP and moved to UK 11/2013
- EEA2 residence card issued in 05/2014
- Decided to separate with my EX in 11/2015
- Divorce procedures started 01/2018 and still nothing yet. ( lots of confusion and not happy with my solicitor really)
- my ex is full time employed , got all her 6 years P60
- I’m planning to apply for ROR without lawyer cause I had enough .
- My ex is supporting and willing to help with any possible thing or document she can.


My questions are :

1 - can I travel this period or it’s a big risk for troubles ?
2 - my ex is over 5 years in UK => can I somehow apply for PR instead of ROR ?
3 - the struggle I have is to “ prove that we lived together “ ...... ( I can’t find bank statements or bills during that period / tenancy agreement was issued for 6 months and we never bothered to change it or ask for new one .. )
I’m not too sure how to prove that. i have nothing ..


I would appreciate your advices , I’m lost, I didn’t travel to see my family since 3 years cause of this and can’t wait to finish this nightmare 🙏🏽

PR after ROR and brexit

Dear all ,

I just obtained my ROR RC.
I’m living in UK since nov 2013 ( over 5 years even before I sent my application) however I got 5 years RC issued instead for some reason .

As far I understand, I’m totally independent from my spouse in term of future applications (PR).

Am I supposed now to use the “eu settlement scheme” for permanent residence ?
Cause my aim is to apply for citizenship as soon as I get all this sorted !

Asssuming that the divorce has not been finalised, you could have applied for PR under the EEA Regulations since the fifth anniversaty of your arrival in the UK as the spouse of an EEA citizen.

If you apply for PR, in order for you to apply for British citizenship, you will need to wait for one year from the date that you are deemed to have acquired PR according to the Home Office database (that will depend on the evidence that you provide).

If you apply under the Settled Status scheme, in order for you to apply for British citizenship, you will need to wait for one year from the grant of Setlled Status/ILR, which may be considerably later than the date that you acquired PR.

1 ) shall I apply now for PR based on the ROR that I just got or I should wait until the “new eu settlement scheme “ will be in place, what’s easier ?

2 ) in my Card says only EU family member , but it’s ROR so I assume home office have my history and I don’t need any of ex-wife documents to be provided . Correct ?

You can apply for PR if you can show Home Office that she was working continuously from your Marriage date to divorce finalised date

Are you sure ?
I just got a document that it confirmes my retained rights ROR . That means I am qualified on my own now .
