Hello,
I am a third country national currently in the UK with my son of 6 years. My son is an EU national and holds an EU passport. I have only be living here in the UK for a few months and entered the Uk with a visitors visa. My son is currently in school and I wish to apply for a residence permit.
I understand I qualify under the Zambrano route as the primary carer of my son who is an EU citizen...
1. Does anyone know if the Zambrano route is the correct route for me to use?
2. What are the requirements for this application?
3. What documents do I need to submit in support of my application?
Thanks for your help.
Rose.

From my understanding, Zambrano derivative residence is only applicable to carers of British children or Adults, not EU children or adults (I may be wrong though). 'A Zambrano right is granted to a non-EEA parent of a child who is a British citizen if it is the only way to guarantee the right of the child to live in the UK (or the rest of the EEA). But it is not issued where another carer may be available for the child (e.g. the other parent)'.

You are right, Zambrano is meant for primary carer of a British citizen child or adult. What I meant to refer to was rather the Chen case law.

You’re eligible for a derivative residence card if you’re living in the UK and you’re one of the following:
the primary carer of someone who has the right to live in the UK
the primary carer’s child
the child of a former worker from the European Economic Area (EEA) and you’re at school, college or university in the UK
If your child is from the EU then i would believe that you are the primary carer of someone who has the right to live in the UK
