Indian partner of a Spanish passport holder.

Hello everyone

I'm posting on behalf of a friend on mine

She holds Indian passport and is dependent on her Dutch husband. Her visa is expiring in November 2019 and she is planning to apply for ILR in November 2019 after she has spent five years in this country as a dependent of her Spanish husband.

Now question is

Under new rules can she apply for ILR now or she has to wait till November 2019

She needs 5 years residence under the EU rules for PR or the settled scheme.

Note that an EEA Residence Card is not a 'visa' as such.

What EU nationality is the spouse exactly? Your subject heading states Spanish but your post States Dutch and then Spanish.

For the settled scheme, it's just 5 years together. Unlike with PR, he doesn't have to have been a qualified person for the whole of the 5 years, so long as there was no decision to expel him from the UK in force during that time.
