Hello guys,
As the title says, Is it possible to apply for both PR and Settled status the same time? I have Retained my Rights as the former spouse of an EU national, and currently qualifies for PR as well as Settled Status.

Both are different routes and I was wondering if I could apply for both and see which one comes first.

when you apply for settled statues it cancel any other application you applying for
so I don't think you can do that , only settled statues will be considered ...

I'm not sure about one application canceling the other in this case, as they are not within the same immigration system: one follows EU law (PR), the other follows UK law (Settled Status). They are NOT mutually exclusive. If you were applying for both ILR (from, say, the Tier system) and Settled Status, then yes, they would definitely cancel out as ILR and Settled Status are both within UK rules. A constraint might be if you need to send your passport or other evidence, for any reason, for both at the same time, then that would entangle/delay things a bit.

However, what you can do, is apply for one, then the other. Many people have done this. Having PR actually makes it straightforward to apply for Settled Status.

Not sure what you actually want to say here? Brexit or no Brexit, EU nationals retain their nationality, and non-EU family members of EU nationals retain their status as EU family members. They just need to register to a different immigration system, that follows UK laws instead of EU laws, but which is nonetheless still designed specifically for EU nationals and their family members!

Actually, there might be reasons why one would like to still have PR, for instance, the possibility of visa-free travel to the EU, which you cannot do with Settled Status.
Apply for settled status
It is ultimately up to each person to decide, based on their individual circumstances what to apply for.

l have applied for both, PR and then for setteled status.(both applications are pending)
caseworker guidance say they have to process both application because applicant can hold both documents at the same time, one under eea requlation 2016 and one under EU settlement scheme.
applying for EU settlement scheme will not cancel PR application.
Have a look at page 29 of EU settlement scheme guidance

This is excellent. I am going to apply for both then. Thanks

" Actually, there might be reasons why one would like to still have PR, for instance, the possibility of visa-free travel to the EU, which you cannot do with Settled Status."

OP is no longer a EU family member so how he will travel VISA FREE with PR if he is not joining or travelling with his ex Eu family member ?

I have applied for both, PR and then for setteled status.(both applications are pending)

Great but i am wondering you will BRC under EU law or BRP under EU settlement Scheme. You won't get 2 posted to you. So if they send you BRC under EU law then you will only get online proof under EU settlement scheme .. Documents certifying Permanent Residence (PR) will cease to be valid from december 2021 or december 2020 ( if no deal brexit )

Oh OK, yes I see what you mean. In this particular case then, no, the benefit of visa free talvel does not apply. This does not mean PR is useless in their case, there are a number of pros and cons, and again, only the OP can decide.

Would be interesting to find out that the outcome is of this. Just to be clear, I said it was straightforward to apply for PR then Settled status, not both at the same time.

Actually they are valid until December 2020 whatever outcome.
