EEA Family Permit - Reapply After 6 Months?

Hi,

I am in the process of collecting documentation to apply for an EEA Family Permit. My wife is going to attend University in the UK for 1 year for her Master's Degree and I am aiming to join her.

The EEA Family Permit is only valid for 6 months and then it expires. Am I allowed to just re apply for another 6 months after? Since my wife will only be in the UK for a year, I don't need a 5 year Residence Card.

What are my options so I can spend the whole year with her in the UK?

Thanks!

You could do this, but Family Permits are only possible to apply for from abroad, so you would need to leave the UK, apply abroad, then come back in with your new permit.

The fact that you only need 1 year does not mean a 5-year Residence Card is not the right document for you. In fact, in your application, you can declare that your intention is to stay only 1 year, and I believe, they could issue you a 1-year card. You would pay the same fee of £65, so this would be an extremely silly thing to do (what if your plans change and your wife has an opportunity to stay a further or a couple more years, which is not uncommon after completing a Masters?)

The other option is for both of you to apply for Pre-Settled Status, which is free, once you are in the UK. Again, this will also give you 5 years.

No other immigration route is adequate for your case (and all others are extremely expensive in comparison).

I'm not sure, but I supposed, it could be an issue. If you apply for pss during your 6 months stay, then you stay further 6 months from your 5 years of pss duration,So if you return back to your country after 6 months then you may need to come again to the UK.Then,it will be a question of regularity as 6 months of residence is expected in a 12 months period in pss if you go for settled status. But,if you don't wanna,it's ok.
So, you may need to seek more advice from experts.

Hi potolot2 & kamoe,

Thanks for your reply.

I guess I will just apply for the Residence Card immediately once I arrive. Hopefully that will just save us some headaches down the road.

Thank you both for your help and advice!
