Permission to marry

Good day everyone,
I have a question.
If a Non-Eea national is resident in the UK on a UK spouse visa and their British Citizen spouse has divorced them and a decree absolute has been granted, would the Non-Eea then be permitted to marry an EEA national whilst they are still resident on a UK spouse visa, or would such a situation arouse the suspicion of a registrar/vicar and thus be referred to Home Office for investigation?
