EU Settlement Scheme - Zambrano

Dear All,

Just seeing if anyone can provide some advice for my friend.

My friend has a paper Immigration status document due to expire on the 21 Aug 2019. It is a derivative residence card.

She is a Chinese national with two British children and the partner is a British national he is the father of the two children. They continue to live together as a family.

We have called the EU Settlement Resolution Centre and explained the circumstances to them but where told the EU settlement scheme does not apply and that she must make another type of application.


Is my friend able to apply for settlement?

I will suggest calling the Eu resolution centre again and telling them that you want to apply as a primary carer of a British citizen ie joint carer. You may probably speak to someone else who may help you with much more information.

Your Chinese national friend should be able to apply for Settlement Status with proof of having resided in the UK continuously for five years.
Appendix EU of the UK Immigration Rules wrote: UK Immigration Rule EU11(3)
(a) The applicant is:
...
(v) a person with a Zambrano right to reside; and
(b) The applicant has completed a continuous qualifying period of five years in any (or any combination) of those categories; and
(c) Since then no supervening event has occurred
