I am non EEA member where I got EEA family visa which is expired on may7th 2019 where I extend it where it’s refused
I have been applied for EEA family extension after 5 years where it’s been refused so I am applying for right to appeal.

1)I will be completing 10 years by end of December 28th 2019 so whether I am eligible to apply for ILR 10 years route ?
2) during my refuse of EEA extension application when I apply for appeal whether I still continue with right to work or I should work at all ??

It would help to post you full immigration history in the UK.

Reasons for refusal
We didn’t live together for 1 year before divorce
My ex partner doesn’t lives in Uk for 5years
Not info evidence for approval

Can I apply for 10 years route visa as I am in Uk for last 9years 6m

For ilr based on 10 years long residence, you require all the same evidence of your EU spouse being a qualified person exercising treaty rights for whole time you are claiming under the EEA route. If your eea or or application failed then ilr LR will also fail.
