Absences from the UK , mathematical problem!

Hi , everyone.
I am about to upgrade my EEA family member visa.
I have never been abroad for more than 177 days a year , a calendar year that is (JAN 1-DEC 31) Now I read the law again and it says "...180 days absences in any given 12 month period"But when I count for instance a tax year (APR 6 - APR 5), suddenly those 177 become 184 days
must be some kind of math paradox beyond my understanding...
My question is , who gets to dictate when the 12 month period starts and ends , me , the Home officer or do we meet in the local pub and trow dices about it?

Hello
It's a sliding 12 months window. It's not specific calendar or tax year. It's any 12 months that can b taken between any 2 dates.
If you are often out of the country, you can then go in excess of that.
So you in your case, you were out of the country more than 180 days in a given 12 months period.

Thank you on a good answer but the logic says , if you go abroad for no more than 90 days at the time and than stay in UK at least 95 days once a year you should never be able to exceed the 180 days limit at any given 12 months period... But pure mathematics say otherwise.Crazy

Read on several trustable sites (can't link on smartphone) that is required in order to get settled status.
