Pre-Settled/Settled Status Update

Hi Guys,

I am beginning to have a clearer view of the visa processes but I just needed to confirm this for the last time please.

Apparently, my wife has just secured her EU Settled status as we were waiting till October when our marriage will be 5years so we can both apply for the EU Scheme. Now, knowing that she already received her Settled Status and I have been in the country since 2013,got married in 2014,received my EEA Residence Card in 2017 which by law,I should be qualify for my ILR by completion of 5yrs in marriage come this Oct.

Here is my question:
-Is it right to apply for the settled status now and is it still via the same mobile app EU Scheme or paper based (knowing my wife just secured hers) or I still have to wait till October when marriage clicked 5yrs? My residence in the UK already surpassed 6yrs.

-My son was born in the UK but uses European passport due to the Mum's status as at the time,but since she now has a settled status, I want to believe we can apply for his passport.Does anyone has direct link for this application requirement?

Any candid advice will go a long way.

You can apply any time, but if you apply before the 5 years are complete you will only receive Pre-Settled status. The HO encourages people in your situation to wait and apply only when you complete 5 years (otherwise you'll need to apply twice, once now for Pre-Settled, then again when the 5 years complete for Settled Status).

This is irrelevant. Only time spent officially as the family member of an EU citizen counts towards the 5 years. Unless prior to your marriage you were issued a EEA RC or Family Permit as the unmarried partner of your now wife -then fiancée- UK residence before your marriage does not count.

It is my understanding children qualify for British citizenship if they are born in the UK and one of the parents has permanent residence/ILR/Settled Status.

Please note that applying for Brtish citizenship is different than applying for a British passport (this actually applies to any nationality; you can be a citizen of any given country all your life, e.g. UK citizen, and never have a passport. Think of your own nationality... when was the first time you applied for a passport in your own country? Before that date, were you not a national of that country?).

Finally, the marriage will be 5 yrs precisely 20th of October, do I have to wait till the day or I can apply first week of October? What’s the time lapse one can apply if you don’t want to wait till the actual day.

Thank you so much.My curiosity quenched on the EU Settlement Scheme...😀

By the way, I didn’t get a full response on my son’s British passport application. Is there any URL link to follow as there are so many links on British passport application?
