EEA Permit query

Hi,

Let me give a brief background to my query. My brother-in-law is an Italian citizen who has been living in the UK for one and half year now. He has two kids 7 and 3 who also have Italian passports but my sister is a Pakistani citizen who has Italian residence permit. She along with her kids is living in Pakistan for last 2 years now. My brother-in-law has recently been diagnosed with cancer which is in quite advanced staged and he is going through his diagnoses and treatment hence unable to travel.

He really wants his kids and family to be with him in the UK while he goes through the treatment and as per him if he travels from Italy to the UK along with his family, his wife will allowed to enter the country on family residence card without any need for visa but since he cantr travel now and he has recently got his pre-settled status in the UK, he now wants to apply for EEA Permit for his wife so she could travel on her own from Pak and join him here.

I have also been told that his hospital can issue a letter describing his illness and why he can't travel and my sister can then travel from Italy with her kids without him in accompany. Does anyone know about any precedent or applying for EEA Permit is the only way?

Any help would be really appreciated.

They can simply apply for EEA FP. There is no need to accompany non-EEA if EEA FP was issued.

I see no chance crossing the border without husband and FP

Thanks for your reply. Should they apply for "EU Settlement Scheme family permit" or "EEA family permit" since my brother-in-law has pre-settlement status?

They can apply for either one of those. His UK Status doesn’t stop them from applying for EEA FP within EU rules
