I will apply for an EEA family permit. I have an ongoing criminal case against myself. Risk of denial?

Hello. I am the spouse of an EU citizen and I want to apply for an EEA family permit because my wife and I are planning to have a road trip to the UK with our van. I have an ongoing criminal case against me because I'm accused of hitting someone. The court initially sent me a fine of about 1000 euros but I appealed and haven't heard from court since then. I have no criminal record.
Could this be an obstruction to getting an EEA permit?
And extra question: they require proof of hotel bookings and flight bookings. We will go through the channel and sleep in our van. What to do in this case?
