EU Settlement Scheme - Non EU Family Member

Hello All,

I am asking this question on behalf of a friend. This guy has a brother who is EU Citizen and just recently got his EU Settled status. Now i need to ask a few question regarding his application:

1- He (non-Eu Brother) does not hold UK visa / Biometric Residence Permit or any uk legal status. Although he does have a valid passport.
2- He had applied EEA route in past, H/O was satisfied with the relationship (with his Eu Brother) part but they refused him due to the reason his brother was receiving benefits so their concern was how his brother supporting his Non-Eu relative whilst being on benefits himself.


In view of circumstances above can this gentleman make an application under EU Settlement Scheme ? also does his EU relative need to satisfy how he is supporting him financially under this scheme ?

I would appreciate any help from good people here.

Hello

The brother is considered as extended family member.

An extended family member cannot apply under the EU Settlement Scheme without having an EEA card (Family Member of an EEA National).

As result, an extended family member refused under EEA route (EEA EFM) cannot use the EU Settlement Scheme as a workaround.
