BRP(non EU) to BRC (EU)?

Help needed please with unmarried partner in trouble!

He has expired BRP (leave to remain was given twice for two years each, with last one expired years ago, he got it as out of rules case).

All this time he is living as unmarried partner of EU person but never applied via this route for BRC. EU person got settled status via EU scheme recently.

Question is what he has to do now? Apply for BRC (via EU route for free) - sending his expired BRP? Will he be denied BRC as his BRP was expired? He was living with EU person for 10 years so theoretically he would qualify this way? Their child is 9 years old who has settled status as EU citizen. What if there would be a problem that his BRP was expired for years?

Perhaps he should apply for new BRP as non EU person? But this is expensive and difficult.

Unmarried partners do not have automatic residence rights, so if he has not had any alternative residence status and never applied for the EEA route, then he has likely been in the UK unlawfully. Why did he not apply when his last BRP expired?

Because he did not have money to pay to lawyer. Plus EU person did not understand lawyer at all, what does he want about papers.
Now how can he apply as unmarried partner of EU? What papers would he need? Last BRP expired in 2018 so 2 years ago.EU person got SStatus only in 2019.
