Eu Pre settle status

Hi,
I am from India. i have been in uk from 2005 to 2011 and did overstay for 2 years. ukba arrested me and kept me in detention and then i left the country voluntarily .
in 2014 i moved to Denmark and i got Danish citizenship in 2019.
Can i come to Uk now and can i apply fro eu pre settle status as i have very bad immigration history in uk including marriage of convenience.
Now I came to UK last week with danish citizenship and want to apply for pre settle status. can i be refused eu pre settle status if I apply

Costs nothing to apply worth a try i guess

The ones i saw were due to criminal offences.

They tend to only refuse due to serious criminal offences. You overstaying will be taken into consideration however your application will be judged on your circumstances at the time of the application in regards to nationality. Since you are applying as a Danish national and have since entered the UK legally, this shouldn't affect your claim to pre-settled status. It also costs nothing to apply so it's worth a shot.

You also being involved in a marriage of convenience could still mean you will be open to investigation should any future marriages take place if you ended up sponsoring a non-EEA national, however you still should be eligible for pre-settled status regardless.

Thanks for your reply. Just one question while filling the pre settle status application should i attach a cover letter explaining my previous immigration history as non eea national to be just on the safe side.
I think It can go against me or in my favour. As in the rules it is written that misleading or hiding facts which can have impact on decision of pre settle application.
