Hello,

My wife and I (me: UK citizen, Wife: Chilean citizen) moved to the UK in Jan 2018 with a EEA FP and now holds a valid EEA BRP under Surinder Singh.

We have just had our first child and have been sent a "entitlement to NHS hospital treatment questionnaire" asking to prove our validity to free care from the NHS.

My wife has worked full time since May 2018 and paid taxes etc... She holds a UK issued EHIC card.

Am I right in understanding that she is entitled to free care from the NHS, or should we have paid the immigration health charge???

Im a big scared of a potentially huge bill coming through the door.

Entitled to free NHS as she holds a valid EEA RC.

Note the immigration health surcharge does not apply to EEA route applications.

Thanks, that's what I thought... I just began to double think by previous research.

I'm not 100% sure on which area of the form to complete. There are the following sections:

1: EEA & Switzerland Nationals - to be completed by EEA (EU) & Switzerland nationals only
A. To settle and work in the UK
B: To join a family member/settle in the UK
C: Student (irrelevant)
D: Visiting the UK (Irrelevant)
E: Other reason for being in the UK

2: Non-EEA Nationals - to be completed by non-EEA nationals only
A: Non-EEA national to join a family member who is an EU national
B: Non-EEA national to join spouse/partner
C: Non-EEA national to work/settle
D: Asylum seeker/refugees (irrelevant)
E: Visitor to the UK (Irrelevant)
F: Visitors from countries with Bilateral agreements (irrelevant)
G: Other


Am I correct in saying that I need to fill out section 2A as I (as a UK citizen) am considered an EU national exercising my rights?

There is a section where I can explain why I am exempt from the immigration health surcharge.

Is anyone able to assist if possible? Tried calling the overseas patient office for my hospital, but they never pick up.

I'm unsure whether to complete A or B below for SS EEA2 BRP:

2: Non-EEA Nationals - to be completed by non-EEA nationals only
A: Non-EEA national to join a family member who is an EU national
B: Non-EEA national to join spouse/partner

(5) Where these Regulations apply to F or EFM, BC is to be treated as holding a valid passport issued by an EEA State for the purposes of the application of these Regulations to F or EFM.

Hence, I think

A: Non-EEA national to join a family member who is an EU national
