APPEAL RIGHT FOR EU SETTLEMENT SCHEME APPLICANT

In accordance with the withdrawal treaty, the government has promulgated a new regulation.

Regulation 3 of the exit Regulation 2020, makes provision for a right of appeal for an application lodged on or after the 01-02-2020.
Those who applied before that date will not have a right of appeal.
Those who receive a curtailment decision or a refusal to vary their leave will be able to appeal if as a result of the variation they are without leave to appeal.
Those granted pre-settled status when they are entitled to settled status will be able to appeal aswell.
