EU settled scheme Family Permit by dual EU & UK National

Post by Sobia K » Tue Feb 04, 2020 12:19 pm

Hi all,

I have a question about the EUSS Family Permit Visa, I am a Portuguese National and have last year acquired British Nationality. I applied to a Permanent Residence Certificate before the introduction of EU Settled Status.

There is a prt in the beginning of the EUSSFP application that states

" who is a relevant naturalised British citizen who would qualify for status under the EU Settlement Scheme were they able to apply for it"

so couple of questions
I just want to check if I can use this route being a dual national.
If the PR Documentation introduced prior to EU Settled Status Scheme is same as EU Settlement Scheme.

Many Thanks

Sobia

You "should" be able to use EEA law in the context of Surinder Singh or Lounes.

However, it depends on many factors. Your post doesn't say enough about your plans in order to tell you if yes or no it's doable.

This seems like a Lounes case.
