EEA FP

Hi everyone,

I have a few questions regarding EEA FP.
So a little introduction, I am French, living in France, with the desire to settle down in the UK with my Ukrainian wife (long distance relationship that turned into a marriage last december) living in Ukraine.

We would like to go with the EEA FP route so that we can go there together, before we apply for the EU settlement scheme.

So we started the application already (after having translated our marriage certificate), and we have some questions.

1) She has a patronymic name in her birth certificate and in our marriage certificate. But in her passport, it doesn't appear.
So in Given Names, should we mention First Name + Patronymic Name or just her first name (so that it looks like her passport)

2) I've read it in the two topics, but just to make sure, she doesn't have to take a TB test right?

3) We met 4 times within a year and a half, do you think that's enough for a proof of us being together?
You know... they seem suspicious because we don't live together yet.

4) Passports. Does she need my passport to take it to the application center? It's physically complicated given we don't live in the same country.
Can a scan of my passport be enough? It's a bit confusing because they ask to bring passportS on the appointment.. but I won't be there unfortunately.
I went ahead and made a certified copy of my passport in my city hall and scanned it for my wife, will it be enough?

1 - Align with her passport

2 - No TB test for EEA nationals family members

3 - It's up to you to demonstrate that your relationship is genuine. A certificate of marriage on its own is usually not enough.

4 - She needs your original passport to apply. You can keep you French Carte d'Identite Nationale to travel but give her your passport. It's essential that she demonstrates your are an EEA national.

Are you still in France or did you start exercising Treaty Right in the UK.

It's not possible for her to apply for EEA FM from Ukraine while you reside in France. You need to be in the UK to sponsor such application.

I'm still in France yes, I thought we could do it by saying that we intend to go there within 6 months?

I can't really mail my passport to her, and can't really travel in Ukraine and leave without my passport :/

Would our only option be for me to be in the UK, apply for the EUSS and then for her to apply for the EUSS FP without her having my passport?

One of the major weakness or your application is the fact that you met 4 times only and you don't live together outside the UK.

If the Home Office turns around and decide to interview both of you and ask crossed questions, I don't think you know each other enough to survive such interviews.

That's why you have to thread carefully here. It's enough for them to say they are not satisfied that your relation is genuine to build a strong refusal case.

I don't believe it's wise to lodge an application from Ukraine, while you live in France with the intent to go to the UK. You will highlight the fact that even outside UK, you don't live together at all.

I appreciate that circumstances can vary widely in the course of a normal human life, but immigration rules don't contain scenarios for all situations.

Thank you for your answers, that will be up to them to decide whether it is genuine or not, but we're quite confident about what we have.

What about the other option, if I go in the UK and apply for the EUSS, and then for her to apply for the EUSS FP?

You can indeed come to the UK first and start exercising Treaty Right immediately then she can apply to join you.

However, you may still face questions about the relationship.
