EU Settlement Scheme

Hi guys,

I am a non-EU spouse of an EU Citizen and we both plan to move to the UK next month. I currently have a valid UK Visiting visa which still has one year validity. My question is this: Do I still need to apply for EU Family Permit in order to accompany my EU Spouse to the UK, given that I have a valid UK Visiting/Tourist Visa? Secondly, should I enter the UK with my existing visiting visa, would it be possible for me to apply for pre-settled status with such visa? Please I need the forum to help me out with these questions.

If you are legally married as recognized in the UK (islamic marriage only does not count), then in theory you can come to the UK with your spouse, armed with your passports and marriage certifficate, and without the need for any visa. The usual problem with this, and hte reason the Family Permit is advised, is when people do not have visas and their nationality requires it, as some Airlines do not allow them to board the plane, regadrless of their legal rights to accompany their EU family members.

Given you do have a visa, you should be double covered and airlines will not make an issue.
