Currently, I am a tier 2 visa holder and my wife and children are PBS dependent.

So my wife and children are Italian by birth, but they still need to do some procedures and complete some paperwork to obtain their Italian identity and passport. They will do this in a few days.

After she obtains her Italian ID, we can apply for a settlement scheme, and then I will have a COA and after a few weeks or months I will get a residence card, that is totally clear to me..

What is not clear is: can I start working for a different employer once I get the COA?

Does the insurance number remain the same after changing the tier 2 for the EEA family member?

If it says on the COA that you have the right to work, then yes.

Nope. It stays the same. I have had Tier 4 Student, Tier 1 Post Student Work, Tier 2 Work, EEA family permit, EEA residence card, Pre-settled status, all thoughout over 10 years in the UK, and my NI has not changed.

Nope. It stays the same. I have had Tier 4 Student, Tier 1 Post Student Work, Tier 2 Work, EEA family permit, EEA residence card, Pre-settled status, all thoughout over 10 years in the UK, and my NI has not changed.

Hi all, good morning.

I'm currently a tier 2 holder living in the UK with my family.

My wife is Italian by birth, however, she doesn't have any Italian ID or passport yet.

She is going to Italy in order to ger her docs, but it will take some time. I'd say around 50 days.

My current BRP card will expire on the 7th of October and due to coronavirus pandemic I was made redundant, so won't be able to extend my leave with my current employer. I have been trying to get a new job and apply for a change of jobs under tier 2 visa, but I dind't have any luck so far.

So, I have three options.

First, I would go to Italy with my wife and wait there until she gets her docs (I'm Brazilian and I don't need a visa to stay in Italy for up to 90 days) and then come back to the UK.

Second, I would wait in the UK until my wife comes back and then apply to the EU settlement scheme, in this case, in this case it is very likely that I will overstay my current leave by 15 or 20 days.

Third, I would apply for the EU settlement scheme using her Brazilian doc, it will be refused of course, but it will give us some time of waiting for a decision. Technically I won't be an overstayer once I'm waiting for a decision on my application (not sure about that).

My tendency is to choose the second option. My question is. Will this imply anything in our future in the UK? Will this imply in any way when we apply for ILR?

Any thoughts would be very appreciated.
