EU FAMILY PERMIT REFUSED FOR MOTHER IN LAW HELP PLEASE

Hello Everyone
i am so surprised it seems Straight forward when applying for FP for mother in LAW .Even on FP guide states dependency is assumed if you apply for FP ,
but mine application for my mum was refused so upset
I am Uzbek my wife from EU we both settlement granted i been sending my mum financial support from 2014
i provided all documents
• Marriage certificate
• EEA family residence card
• Passports and settled status for both EEA family members
• Payslips SHOWING I SUPPORT MY MUM
• Birth certificate of mine proving that he is my son
• My Uzbek Bank statement with money support
• Proof of my Property Ownership in Uzbekistan Tashkent
• Property lease and contract of my Son's flat with accompanying letter from landlord
approving my stay
• bank statements 6 month money transfers (even its not a requirement )
also provided 6 month bank transfers showing her dependency but still refused based :

-in order to meet the relevant EEA Regulation 7 you must demonstrate that you are a *DEPENDENT DIRECT F.M* OF YOUR EEA sponsor and that your EEA sponsor is a qualified person .This means relatives of the EEA national in the ascending line must be dependent upon their sponsor .Financial dependence should be interpreted as meaning that you need the financial support of the EEA national or his or her spouse / civil partner in order to meet your essential needs in the country where you are present and that the sponsor will be able to suppport you once in UK

THAT IS BIG BULL SHEET AS WE ATTACHED BANK STATEMENTS ,PAYSLIPS ,JOB CONTACT

ANOTHER STRANGE THINK IS

- You state that your sponsor entered UK 2001 .However ,you have not provided any evidence of dependency on your sponsor .This office would expect to see regular money transfers from date your sponsor entered the UK to present .As such ,this does not demonstrate regular and sole dependancy on your sponsor

STRANGE COS WE GOT MARRIED IN 2016
ANY ONE HELP PLEASE HOW TO DEAL WITH THIS SITUATION

If your application was made after 31-01-2020, i believe there will be a right of appeal.

can i appeal ,
all dependence was from me as i am son but i am non EU married EU , i have prove me supporting my mum but not my wife how i can put it right on appeal ?

Did you apply settlement scheme family permit?

Dependency is not assumed with EEA Family Permit

If they insist on dependency from your wife, then that is wrong.
It will appear that consideration was given to your case under the EEA Regulations as opposed to appendix EU family permit under the rules.

When did you apply?

If your wife (the sponsor) has pre settled or settled status, you can apply for EUSS family permit instead of EEA family permit. Dependency is assumed under EUSS so it might be easier than to appeal as this can take months.

If your wife (the sponsor) has pre settled or settled status, you can apply for EU Settlement Scheme family permit instead of EEA family permit. Dependency is assumed under EU Settlement Scheme so it might be easier than to appeal as this can take months.

Dependency is assumed in the case of direct descendents in the assending line.

But your case was dealt with under the EEA Regulations as opposed to Appendix EU.

Even under EU, they were wrong to refuse to accept dependency on you.

i will not proceed with appeal . cos as applied for FP been asked to prove my mum dependency
What application should i use to bring my mum to UK
i am non EU my wife is EU both with settled status ?

my previous was refused and it was EU FP .

Also i have a question at the begging of application when applying for EU Settlement Scheme Family Permit which to select ?
Selecting category you applying for

- Close family member of an EEA or Swiss national with a UK immigration status under the EU Settlement Scheme
[ ] I confirm I am applying for an EU Settlement Scheme Family Permit

- Family member of an EEA National
[ ] I confirm i am applying for an EEA Family Permit

which box to tick ?

The question here is about her being close family member or extended family member. Obviously, close family members get it easier. You wont find the terminology "close" family member used liberally, but they refer to 2 categories:

- Family member (read close family member)
- Extended family member

As you see, the mother of the spouse of an EEA national is a close family member.

Anyone else, not in that list, would go under extended family member.
