Retained rights of Residence and absence

Hi,

Mb someone knows the answer, asking for a friend. She is married to a guy and they are 4 years in marriage but in UK they are 1.5 years. She holds pre-settlement status. They decided to divorce, I told her to apply for retained rights ( not sure how).

The question is: She is now 2 months absent from UK and plans to be absent for 1 more months mb 2. is it somehow bad for her case? She has been living in UK for 1.5 years and now absent for 2 months.


Just to clarify: She came to UK - in March 2019, lived in UK until July 2020 and left for a couple-4 months. Will it be a problem for her and it is better for her to come back now while she is absent for 3 months only then 4 months.

Sorry for such a mess in the previous message. Just to clarify my question, the demand to reside in UK for 1 year, is it a demand to be in residence for 1 PREVIOUS YEAR? IF a person has been living for the last 2 years with a gap 4-5 months in the second year, is that person qualified?
