Hi sir I have applied for pre settlement status as extended family member but my uncle moved back to germany but his paper work is continue like his pay slips r up to date and bank statement.my question is this will effect on my pre settlement application or not.or it will not be an issue because his tax is still going and bank statement is up to date?

Your EEA sponsor has the right to travel to Germany without compromising your status.

Now, if he leaves the UK for good and transfers his taxes and affairs to Germany, that's indeed a big issue for your status.

He is not moving his taxes back to germany he is just claiming german state pension not claiming anything from uk.his tax is still continually going to uk tax department.he didn't claim pension in uk because he is not eligible for uk pension.

Is he registered in Germany?

Registered for what ? He lived in germany for whole life mean he is registered

I believe he has an Anmeldung there as there.

He is probably registered in both countries but for different purposes.

I gather he lives in Germany but he keeps a nominal footprint in the UK to help him with his immigration.

From the OPs past posts, it seems he has been tryng for an EFM RC through his uncle since 2015 and has been refused a few times; finally getting the EFM RC last year.

Technically, if the sponsor left the UK, the EEA EFM is toast.

But as long as he kept a footprint by leaving some tax affairs, it may stay under the radar.

So you are saying that you are fradulently claiming residency based on your uncle living in the UK, when they actually live in Germany.
What is your question? Sounds like "will I get caught" and the answer is yes. Probably and hopefully.

How can u say its fraud uk245? Think twice before u speak.he is living in uk from 2014 to till now before lockdown he been to germany to see his sister but due to pandemic he stayed in germany because he said germany is more safer for him because he is over 65.and now he is coming back next week

I wouldn't bank of that. The DWP are getting very good at catching benefit fraudsters who have moved abroad but claim they are still in the UK: using the exit checks; using the credit agencies to check they have a credit footprint in the UK. Somebody from the Repbublic of Ireland said they recieved a IUC (Interview under cautiuon) letter and that is the CTA with no border checks! IUC letters arrive when they have the evidence.

They only have to suspect fruad, to be be able to check other things, e.g. looking at their bank statments and those of family too if needed.

In Germany, as in most European countries except for the UK and Ireland, everybody has to register their residence with the local municipality. If you move within Germany, you register with the new municipality within 14 days of of moving. Your German ID card is updated with your new address and the authorities where you used to live are informed that you are now resident in town XYZ.

When you leave Germany permanently, you have to de-register.

So, if your uncle is registered in Germany, he is no longer resident in the UK.

That's true between German authorities. But when I a German registers in Germany and his previous address is abroad, they don't contact foreign authorities to tell them about it.

It's not illegal to live in multiple countries at the same time. It's punishable to use it to obtain advantages we are not normally entitled to.
