Spouse pre settle to Chen settle staus

hello guys, need some help plz.

started live together with european partner with all proves like bills & lease from Oct 2014 and baby born Oct 2015
applied first residency card in december 2015
married to european national october 2016
got residency card in 2017

i applied for settle status on the bases of relationship and today i got phone call from Eu Resulation centre and they said you are not entitle for settle status until MAY 2021. because HM have recognised your relation from May 2016. but you are entitle for settle status through CHEN Application because your baby is 5 years now and we have sent you CHEN application form.

so my questions are,
what should i do in this situation? should i apply through chen? i don't want to wait until may 2021 as it is very near the deadline for applying EUSS?
how HM have recognised my relation from May 2016? why not from the date we start living together or the time i applied for first residency card?
time to permanent residency or settle status not start from the time i received COA from HM for my first residency card?

You are just making it over-complicated for yourself.

Accept the Pre-Settled status. Once you do that, the June 2021 is no longer relevant for you. There are people coming to the UK just new and getting the pre-settled status. They will apply for Settled status in 2025.

After June 2021, the EU Settlement Scheme won't accept new entrants. But anyone already there, will just keep going as usual and progress to Settled status.

Chen is a derivative right. It long and complex. If you apply new, in May 2021 you will be still waiting for an answer. While if you wait May 2021, you will get your Settled status quickly.

PS: Unmarried relationship with an EEA national is not recognised if no Article 10 is held during that time.

guys truth is i m more scared from relationship brake-up than June deadline. my relationship is on the edge i not see we will be together until May. We both are thinking to get separate so therefore i was thinking if i apply settle status on chen route (especially when HM offering me) so even if my relationship break my immigration status not get effect. please any advice ?

my solicitor advice me to accept pre settle status and then straight after i receive pre settle apply for settle status on Chen route. he said you will get settle status around February, March, April if i apply in October, what you think about this one?

very stressful time, don't know really what to do. now just your advice can help me to decide something. thanks

Really?? And both of you just conveniently have the same name and virtually identical email address. And your circumstances are identical, including the dates, as the other user!!

- Take the Pre-Settled status. This will put you in the system and you will have time to qualify for the settled.

- Apply under Chen because there is nothing to lose

- If by May, you don't have a response for the Chen, apply for Settled status as you will qualify for it anyway

- If relationship collapses, you still apply in May as you would have retained rights anyway. It means you qualify even if you are divorced by May.
