EU Scheme - Change of Name got complicated?

Hi Everyone!

I, Austrian citizen, received settled status once the EU scheme launched and through me, my wife got pre-settled status (US citizen).

As during our wedding our passports were still valid for a few months, we decided to wait until they were up for renewal before double-barreling our surnames. So after a few months of her having pre-settled and me having settled, we updated our passports and our names and submitted the new ones to the EU scheme centre to update our details.

They copied them, send them back and said they're now being processed in the system which might take a bit due to Covid, that's fine.

However, my wife asked if she can travel using her EU Scheme Biometric Residence Permit in her old name and asked if she would be getting a new one in her new name. The person at the EU resolution centre advised her that as far as he is aware, they only update her details electronically and for the "BRP" questions she needs to call UKVI.

So she did. But they told her that in no circumstances do they have or will they ever deal with EU Scheme BRP - that's what the EU Scheme Resolution centre is for. So they can't answer those questions or issue her a new "BRP" in her "new" double-barreled name.

What do we do from here? Does she just use her old BRP in her "old" name (as it's now double-barreled she still has her old name in her new name)?
Do we fight with the EU Resolution Centre?

Is the EU Scheme BRP not a "BRP" in the UKVI sense?

We want to travel to Austria for Christmas and we don't want any issues at the border? And it seems no one can answer if we will or won't have issues?

Hello

I think you are over thinking it. As a non-visa national, you don't necessarily need a EU Settlement Scheme card or need to have a name in it exactly as it appears in your passport.

You can apply for an updated version indeed but it's unlikely that you will get it before Christmas. When you return, just use eGates with US and Austrian passports and you are in the UK. Any status is checked electronically from passport records.

It's more critical for visa nationals as they can't board a plane without proving their immigration status in the UK to the airline company.
