Good day all, I apologise in advance if this question as already been asked on this forum.
I am a non-EU citizen married to an EU citizen and we both have settled status. I will like tobapply for EUSS for my nephew who is financially dependent on me; my questions are:

1. Is my EU wife the sponsor of the application or me?
2. Apart from bank statements, what other proof do I need to provide to show my nephew is dependent on me.
Thanks in advance for your assistance.

Does your nephew have already a EEA family permit or residence card as your dependent relative? The EUSS route is closed for dependent family members unless this is the case.

Thanks for the reply. No my nephew doesn't currently have a EEA family permit or Residence Card. He has never been to the UK.

In that case I'm afraid he is not eligible to apply to the EUSS as dependent relative.

The ability of EEA citizens to sponsor Extended Family Members (any family member other than spouses, children and dependent parents) ended on 31st December 2020.

Do you mind answering the 2nd question from my original post in relation to my parents instead of my nephew.

Assuming same questions for parents, provided you got married before December 31st 2020, they can apply. Otherwise, they cannot:

1. The sponsor would be your wife, the EU citizen. Non-EU citizens cannot sponsor. The relationship would be "parents in law".
2. Proof is your marriage certificate, dated before December 31st 2020; and birth certificate, showing your parents are indeed your parents.

For parents, or parents in law, dependency is assumed, you do not need to prove they are dependent on your wife. Yo do need to tick a checkbox stating this is the case, but that's all.
