Retained rights to reside

Hi everyone! I have a question about retained rights to reside.
I'm not EU without pre-settled status, married to EU citizen with pre-settled. I'm going to apply for divorce.
Which documents I will need to apply for retained rights? Ex refused to provide passport or EUSS number. Is there requirement to be a qualified person? Will I need to show when divorce started?
