EUSS for long-distance unmarried partners.

Hi,

I’m a Chinese citizen and I have been in a same-sex relationship for almost three years with my partner who is from the EU and already got his pre-settled status. I’ll be joining him in the UK this September on a Student visa to pursue a Graduate Diploma. As I was scrolling through the EUSS page It says you can still apply for the EUSS as a family member of an EU citizen if :
  • they started living in the UK by 31 December 2020
  • they have settled or pre-settled status, have applied and are waiting for a decision or are eligible for settled or pre-settled status
  • you’re joining them in the UK on or after 1 April 2021

I think we tick all the boxes, which means I can theoretically apply for the EUSS within 90 days upon my arrival.

The only problem left is the ”durable relationship” part. We have been together since Dec 2018, but we haven’t lived together for anything longer than a month, so we have been in a long distance relationship. But we have met each other in July 2019 in Romania (25 days), Dec 2019 in Beijing (2 weeks) and Jan 2020 in London (8 days). We were considering getting married in the UK in summer 2020, him moving to China to teach English for a year after graduating in Sep 2020, and then permanently moving to the UK upon completion of my undergraduate studies. But of course, COVID came right after I went back to Beijing and then the UK was hit hard, which thwarted some of our plans.

However, as I said — I’ve been accepted to uni, and I’m coming to the UK in September and intend to settle here with my partner. We can evidence our relationship via extensive chat logs spanning the entire period of almost 3 years since we've been together and photographs taken during our trips. We found weblink removed by moderator, where someone had successfully obtained their pre-settled status under the EU settlement scheme without having lived together for 2 years.

Do you guys think our case is strong enough for me to get pre-settled status? One thing we came across while researching this is the EEA Residence Card — Do I need to have one in order to qualify? ( We found that there isn’t sufficient information regarding unmarried partners on the gov site)
