Non EU national Aged 17 When got married

My nephew got married to a EU national before 31/12/2020.His wife is EU national and holding pre settled status.EU national was age of 18 at the time of marriage but non EU national was 17 years old.
Questions
Q1 Will it be possible for non EU husband to apply to join his wife ?
Q2 If age is an issue what is the remedy ?
