Urgent not applied my Pre settled

HI
I am married to EU national (Germany) and i have old BRP Residence card as a family member of EU National which is valid until March 2024.I did not apply for pre settled status by deadline. I have been married for 6 years.
I used online service to check work right and it says i do not have work right and i need to apply for EUSS scheme.
Can i apply for pre settled status now?
will i get pre settled or settled if my application is successful ?
